Introduction

The following Terms & Conditions govern the purchase and use of services, consultations, programs, digital goods, and physical products supplied by Antidote Apothecary (β€œthe Practice”, β€œwe", "us", "our"). By accessing this website, booking a consultation, or purchasing any product or service, you agree to be bound by these Terms. If you disagree, you must refrain from using this website or engaging our services.

These Terms operate alongside our Privacy Policy and form the legal basis of your relationship with us.

1. Use of Website and Services

This website provides information about Naturopathy and Nutrition services, enabling you to book consultations, purchase products and access educational resources. Information provided is general in nature and does not replace individual medical advice. You agree not to use this website for unlawful or inappropriate purposes.

2. Eligibility and Age Requirements

Individuals must be at least eighteen (18) years of age to purchase any service or product. Persons under the age of eighteen may only use this website under the supervision of a parent or legal guardian who accepts these Terms on their behalf.

3. Professional Scope and Conduct

Antidote Apothecary provides naturopathy, nutrition counselling and wellness services within the professional scope permitted in Australia. Information, consultations, programs, and recommendations are intended to support general well-being and are not a substitute for medical diagnosis, treatment, or emergency care. If symptoms persist, worsen, or are of concern, clients must seek independent medical advice from a qualified healthcare practitioner.

No diagnosis of medical conditions or prescriptions of scheduled medicines are provided. Clients remain responsible for consulting their medical practitioner regarding medications, diagnoses, or medical management.

You are responsible for informing your GP or specialist of any changes to medication or health status.

4. Bookings, Payments and Cancellations

All bookings are made through SimpleClinic, and payments are processed via Stripe or Commonwealth Bank. Fees must be paid at the time of booking unless otherwise stated. Consultations are conducted online or in person as scheduled. Appointments may be rescheduled or cancelled by providing at least 24 hours’ notice. A minimum of 24 hours’ notice is required for cancellations. Failure to provide adequate notice may result in the full consultation fee being charged. 

Failure to attend an appointment without notice (β€œno-show”) will result in the full fee being charged. 

If you arrive late, your consultation may be shortened to avoid affecting subsequent appointments. The full fee still applies.

Antidote Apothecary reserves the right to decline service where incomplete, misleading or unsafe information is provided.

5. Client Obligations

Clients must provide accurate, complete, and up-to-date health information. Failure to disclose relevant medical history, current medications, allergies, or symptoms may affect the quality and appropriateness of services. Treatment outcomes depend on your participation and adherence to recommendations. You acknowledge that results vary between individuals and no outcome is guaranteed. It remains the client’s responsibility to follow instructions safely and discontinue any supplement or protocol that causes adverse symptoms.

Clients must notify their practitioner immediately if they become pregnant, start or stop medications, experience new symptoms, or undergo significant medical changes.

6. Product Information

Products sold through this website, including supplements, herbal preparations and natural health products, must be used according to professional advice or label directions. You accept responsibility for ensuring that products are suitable for your individual circumstances.

We take all reasonable steps to ensure the safety, quality, and suitability of products. Clients must follow product instructions carefully and discontinue use if adverse reactions occur. Liability arising from improper use, misuse, failure to follow directions, or interactions with undisclosed conditions or medications is not accepted.

7. Emergency Situations

We do not provide emergency medical care. In urgent situations, clients must contact emergency services or their medical practitioner immediately.

8. Intellectual Property

All content on this website, including text, branding, graphics, formulations, herbs, protocols, product descriptions, and educational materials, is the property of Antidote Apothecary and is protected under Australian copyright law. No material may be reproduced, distributed, or replicated without written permission.

9. Communication and Marketing

We may use your personal information to send newsletters, invitations, service updates, and information about workshops or events. Communications may be delivered by email, SMS, mail, or other channels permitted under the Spam Act 2003 (Cth). Clients may opt out at any time through the unsubscribe link or by contacting us directly. We do not share personal information with external organisations for marketing purposes.

10. Automated Decision-Making and AI Transparency

If automated systems, Artificial Intelligence (AI), or algorithmic processes are used at any time, we will notify clients when a decision affecting them has been made automatically. We will provide transparency regarding the criteria used in such processes and allow clients to request human review where legally required or where the automated decision materially affects their rights.

11. External Services and Third Parties

The website integrates with platforms such as Squarespace, SimpleClinic and Stripe. These third parties maintain their own data-handling practices, and by using this website and services, you consent to comply with their respective terms. We are not responsible for outages, errors, delays, or breaches originating from third-party systems. By using these services, clients agree to comply with the terms of service for each service.

12. Liability and Consumer Guarantees

Services are provided in accordance with professional Naturopathic standards and obligations under Guild Insurance (professional indemnity, public liability, and product liability). To the maximum extent permitted by law, we are not liable for loss arising from reliance on information provided, failure to follow advice, misrepresentation of health information, or any indirect, consequential, or incidental damages.

Nothing in these Terms excludes rights provided under the Australian Consumer Law, including guarantees that cannot be lawfully excluded.

13. Governing Law

The laws of Victoria, Australia, govern these Terms. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.

14. Amendments

We may update these Terms at any time. Continued use of the website and services constitutes acceptance of any amendments.
